Regarding H1 Applying

hey friends

iam graduated in dec-08 and presnetly on my opt which is started on feb 14 of 2009, is it safe to be on opt and apply opt extension and apply h1 in 2010 or just apply h1 in 2009. i dont hav job tight now.

Naadi same situation, and even my consultancy is asking for money to file. I am filing because what if market stays the same and next year there will be more graduates and opt students to file for. yee year chala mandhi cheyatam ledhu so chances are more to get H1 if you file

ippudu OPT lo vunna vaallu paychecks kooda run cheyyavalasina avasaram ledhu. Contact your international students office in university whether they need paychecks for extension of OPT .. konni university rules verega vuntunnai...

I asked my DSO ( DATA SPECIALIST OFFICER) they said there is no need of running pay checks for the extension of OPT we can provide letter like we are working like a volunteer for an organization or company in the related field of our study but the organization or company should be an e-verified company by the government.

I am not applying for H1 this year because the market position is not good and we don't know when this recision will be kicked off so what if we don't get job by august also then in this tight situation it is risky decision to step ahead. So if ur confident of getting job at least 3 to 4mth before ur H1 stats i.e., 3 to 4 mnths before october then it will be good idea to apply for H1

ya nenu kuda apply chestalenu ee sari....its better for not applyin dis time as ther r many reasons and bad effects such as..bench . tax payments...so better not to apply dis time who has opt extension &^& &^& &^&

FIrst with your due respect DSO doesnot stand for ( DATA SPECIALIST OFFICER). DSO is Designated School Official. And coming to OPT extension without paychecks its highly risky. Some lucky guys can get out with out paychecks but it is must that you shud have paychecks for OPT extension.

And coming to whether to apply H1 or to be on OPT : Its better to be on OPT if you sincerly dont have job and are on bench. 99% this time without client letters your I129 will not be approved, even though if it is approved you have to be on payroll from day 1 of Oct 2009 which is diificult with out job for many guys as OPT payroll might cost to 1600 bucks. And many consultancies are not running Payroll eventhough you pay them taxes as INS/IRS ppl are scrutinizing them why they are running payroll for bench candidates. Its always safe to be on F1 in this situation.

AND PLEASE DONT APPLY H1 THRU SHADDY CONSULTANCIES WHO ARE ASKING MONEY FROM YOU TO FILE H1 ....H1 fees according to law shud be paid by employer and not employee. Its just waste of money if you are doing that cuz eventually your petition will be denied without genuine client letter. Anyways this year Quota wont be exhausted so soon so wait till you get Job and then Apply for H1.

This time to apply H1 is a big task but if you are with a potential employer and trying to apply H1 with some inhouse projects then it is good to apply bcoz this time the applications will be very less as people(Employers) r not taking chances this time.

Lot of scrutiny & auditing is going on with employers, so very less people are daring to apply a H1B without a job offer and if you r on bench for more than 2months then the USCIS IRS people are coming hard at the employers. (*"

As far as I know OPT students need not have a payroll running if you need extension, if you belong to OPT then these are the following oyu need t satisfy:

1.Employer must be E-verified

2.You should be with an employer after your opt starts make sure that you are not unemployed for more than 90days.

3.Employed with an employer doesnt mean you need not pay you can say it is non profit organization, self employed, you can be under tranining, voluntarily working which need not be paid.

4. Make sure that you get a offer letter from employer so that it mentions you are working related to the Masters degree.

5. Report your school about your employment even thought you are nto being paid.

If you satisfy these you are good to get an OPT extension. h!~

I was in the same situation

my employer informed me tht he is not gonna apply for my H1B

I had to look for someother employer..

found one had to pay him money for H1B

have seen the news today that...20000 quota was not finished that is a good news...

If u find a chance do apply now because applications are accepted till the quota is filled

hi guys..congrats on u r MS...my sincere suggestion is go back to india n try to get a job..start with 5k but u will for sure get a job n start paying u r loans if u have any...guys as i have been through i am suggesting u..its hourable here...this yr forget abt new job..next yr tooo....guys who know in 1020 things will change???hopefully there is a discusion guing on saying that afater few yrs they may take off h1...i know its hard to take such a decision but that wuld be a wise decisionnext 2-3 yrs there will be no new jobs unless n untill u know some mgr or higher post guy in the company.....all the best
