The biggest impact of the shutdown on Employment-Based immigration will be seen at the Department of Labor, however this does spill over into H-1B processing. Expect that LCAs for H-1B filings will not be processed. Prevailing Wage Requests for PERM labor certification cases will not be processed. And PERM applications will not be processed. This can be detrimental to cases with tight deadlines such as H-1Bs expiring soon that need extensions to be filed, H-1B transfers that need to be filed to start work with a new employer, and PERM cases with advertisements that may be expiring. PERM applications may be submitted by mail if necessary, but there is no option for LCA filings. H-1B filings that are awaiting a certified LCA will probably have to be delayed unless USCIS announces that they will accept H-1B filings without an LCA temporarily.

Here’s the rundown of what we can expect from each government agency:

DOL: The OFLC would cease processing all applications in the event of a government shutdown, and personnel would not be available to respond to e-mail or other inquiries. OFLC’s web-based systems, iCERT (for H-1B and E-3 LCAs) and PERM, would be inaccessible, and BALCA appeals will be placed on hold.

USCIS: USCIS is a fee-funded agency with the exception of E-Verify, so if the government shuts down, only E-Verify shuts down. Otherwise, it’s business as usual.

DOS: Visa and passport operations are fee-funded and should not be impacted by a lapse in appropriations, but operating status and funding will need to be monitored closely. If visa operations are affected, consular posts will generally only handle diplomatic visas and “life or death” emergencies.

CBP: Inspection and law enforcement personnel are considered “essential.” Ports of entry will be open; however, processing of applications filed at the border may be impacted.

ICE: ICE enforcement and removal operations will continue. The ICE Student and Exchange Visitor Program (SEVP) offices are unaffected since SEVP is funded by fees.

CIS Ombudsman: The DHS Office of the CIS Ombudsman would close and would not accept any inquiries through its online case intake system.

USCIS runs on its own funding so its not impacted upgrade it to premium... DOL impact untadi like PERM
