even though it is a non-immigrant visa .... your intention to convert to immigrant visa is valid through H1B... 

antey its dual intent ani meaning.. but it will be based on employers decision not H1B holders decision to immigrate or get permanent...

moreover if it takes too long then extensions may be denied.. so far didint get that scenario but current situations lo you will see USCIS enforcing rejections beyond 10 years

They will just reject and ask them to get out, that's what is going to happen.
