The Trump administration introduced a new policy Monday that would penalize immigrants who use public benefits, such as food stamps and housing vouchers, by potentially denying them green cards. The policy will go into place in 62 days.

1/USCIS announced its long-awaited public charge rule this morning. It blocks legal immigrants from extending their temporary visas or gaining permanent residency if the government decides that they are likely to rely on public benefits in the future.

2/Anyone who’s used public benefits - to which they are legally entitled - for more than a year could be impacted. Medicaid, “food stamps,” some housing programs, and cash benefits, for ex. People can post bonds (min $8k) to prove that they won’t become a public charge.

3/The rule shouldn't impact people who fall into protected categories: Children with special visas who've experienced trafficking or parental abuse, pregnant women. But advocates say their clients are considering dropping off of ALL public benefits for fear of repercussions.

4/My anecdotal experience: Ever since the draft of this reg was published last fall, many immigrants have made a point to EMPHASIZE to me during interviews that they and their children don't use any public benefits. (Even if they're eligible).

Analysts say the policy could dramatically reduce family-based legal immigration to the United States, particularly from Mexico, Central America and Africa, where economies have been suffering and incomes are lower. The rule effectively circumvents earlier, failed efforts by the administration to build support in Congress for a similar “merit-based” overhaul to the immigrant visa system, and fulfills a longtime goal of senior Trump adviser Stephen Miller and other immigration hawks who have long sought new bureaucratic tools to reduce immigration levels. The new rule — from U.S. Citizenship and Immigration Services, an agency within the Department of Homeland Security — focuses on the obscure definition of what it means to be a “public charge,” or someone dependent of U.S. government benefits, and who is “likely” to become one.

Under this final rule, USCIS will be able to objectively determine whether an applicant is likely at any time in the future to receive public benefits above the designated threshold, Cuccinelli says.
