Winning this caseeither by judgement  ( depends on ourcome)  or  through outside court settlement is needed for bjp . BJP mileage  vachindhi through this ram mandir incident and it will play an important part

How is CJI appointed? Not through government?

Article 124 of the Constitution of India provides the matter of appointing judges of the Supreme Court. Though no specific provision exists in the Constitution for appointing the Chief Justice, who as a result, is appointed like the other judges[6] conventionally, the outgoing CJI recommends the name of the senior-most judge (i.e. by date of appointment to the Supreme Court) for appointment by the President of India, as his successor.[7]

NJAC bill passed by parliament was struck down by SC, BJP didnt care to follow up on this matter

so technically SC is unconstitutional as it stands today, they are not responsible to anyone but themselves

Article 124 in The Constitution Of India 1949
124. Establishment and constitution of Supreme Court
(1) There shall be a Supreme Court of India constituting of a Chief Justice of India and, until Parliament by law prescribes a larger number, of not more than seven other Judges
(2) Every Judge of the Supreme Court shall be appointed by the President by warrant under his hand and seal after consultation with such of the Judges of the Supreme Court and of the High Courts in the States as the President may deem necessary for the purpose and shall hold office until he attains the age of sixty five years: Provided that in the case of appointment of a Judge other than the chief Justice, the chief Justice of India shall always be consulted:
(a) a Judge may, by writing under his hand addressed to the President, resign his office;
(b) a Judge may be removed rom his office in the manner provided in clause ( 4 )

October 4 ,2018

Justice Ranjan Gogoi on Wednesday was sworn-in as the 46th Chief Justice of India. He was administered the oath by President Ram Nath Kovind. Prime Minister Narendra Modi and Lok Sabha Speaker Sumitra Mahajan were among the dignitaries who were present in Rashtrapati Bhawan’s Darbar Hall for the ceremony. CJI Ranjan Gogoi is the first Chief Justice of India from the north-east and his tenure will end November next year. As is the norm, Gogoi, the senior-most after former CJI Dipak Misra, was recommended by the latter and the appointment was then confirmed by President Kovind in September this year.

Decision goes either way.I hope it's  a win-win for BJP

the president does not decide by himself

CJI is recommended by Collegium that includes the SC judges, they recommend to PM and PM sends the list to president without any interference even in genuine cases

Yes, president role is very powerful in india on textbook, we all know that is just a plain lie, President cannot act without the PM and council of Ministers

President appoint chestadu , mostly they take suggestion from existing CJI who is abt to leave . His suggestion plays a key role . GOGOI is not in favor of bjp but he still became CJI cuz of recommendation from former CJI
