If process is skipped it could be a point for future cases also, it shouldn't become a reference point.

they might get executed even before 22 anukunta....

media lo full negative ga chepthunnaru ..... like they are not following the rules and fightng in cells anukuntu...

Even before etta chestaru saami time given no.. If mercy plea gets cleared by that time may go ahead..

Jessica Lal (5 January 1965 – 30 April 1999) was a model in New Delhi who was working as a celebrity barmaid at a crowded socialite party when she was shot dead at around 2 am on 30 April 1999. Dozens of witnesses pointed to Siddharth Vashisht, also known as Manu Sharma, the son of Venod Sharma, a wealthy and influential Congress-nominated Member of Parliament from Haryana, as the murderer. In the ensuing trial, Manu Sharma and a number of others were acquitted on 21 February 2006.

 

Charge sheets were filed with the court on 3 August 1999. Sharma was charged with murder, destruction of evidence and other offences, while Khanna, Gill and Yadav faced lesser charges, including destruction of evidence, conspiracy and harbouring a suspect. Others similarly charged were Shyam Sunder Sharma, Amit Jhingan, Yograj Singh, Harvinder Chopra, Vikas Gill, Raja Chopra, Ravinder Krishan Sudan and Dhanraj. The last three named had not yet been apprehended.[3]

 

Seven years after the case was opened, on 21 February 2006, nine of the twelve accused were acquitted, including Sharma. Jhingan had already been discharged and both Ravinder Kishan Sudan and Dhanraj, were still at large. The prosecution had been affected by 32 of their witnesses becoming "hostile". These included Shayan Munshi, Andleeb Sehgal, Karan Rajput, Shiv Lal Yadav and two ballistics experts, Roop Singh and Prem Sagar. After which, in February 2011, it was announced that all 32 would be facing charges for perjury.

President Ram Nath Kovind rejects mercy petition of Nirbhaya case convict Mukesh

President Ram Nath Kovind has rejected the mercy petition of Mukesh, one of the convicts in the Nirbhaya gangrape case.

President Ram Nath Kovind has rejected the mercy petition of one of the convicts in the Nirbhaya gangrape case. Sources have told India Today that the Rashtrapati Bhavan has communicated the decision of the President to the Union Home Ministry.

The Ministry of Home Affairs had earlier in the day forwarded the mercy petition of convict Mukesh Singh to the President, recommending its rejection, officials had said.

The lawyer representing Mukesh, however, said they haven’t received any communication regarding the President’s decision on mercy plea. "We do not know if the decision has been communicated to Mukesh in jail or not. We will find out at 3 pm in Patiala House court," the lawyer said.

Mukesh, one of the four death row convicts in the 2012 Nirbhaya gangrape and murder case, had filed the mercy petition on Tuesday after the Supreme Court dismissed curative petitions filed by him.

"The Home Ministry has forwarded the mercy petition of Mukesh Singh to the President. The ministry has reiterated the recommendation of the Lieutenant Governor of Delhi for its rejection," the official had said.

The Delhi LG had then sent the mercy petition of Mukesh Singh to the Home Ministry on Thursday, a day after the Delhi government recommended its rejection.

The four convicts -- Mukesh Singh (32), Vinay Sharma (26), Akshay Kumar Singh (31) and Pawan Gupta (25) were to be hanged on January 22 at 7 am in Tihar Jail. A Delhi court had issued their death warrants on January 7.

However, the Delhi government had informed the high court during a hearing that execution of the convicts will not take place on January 22 as a mercy plea has been filed by Mukesh.

Nirbhaya's mother breaks down over blame game

Nirbhaya's mother Asha Devi, meanwhile, on Friday made an appeal to Prime Minister Narendra Modi saying "you came to power in 2014 promising safety of women, so please hang them on January 22".

In an interview with ANI, Asha Devi slammed both BJP and AAP for blaming each other over the delay in the hanging of the four convicts.

"Till now, I never talked about politics, I have only asked for justice with folded hands. But now I want to say that those people who protested on the streets with the tricolour and black flags in 2012, today they are playing with my daughter's death for political gains," Nirbhaya's mother said.

"Some are blaming the government for this delay in delivering justice while some are saying give us the police and we will hang the convicts in two days."

Slamming Delhi minister Manish Sisodia, she said, "Manish Sisodia Ji is saying they will hang the convicts if they get Delhi Police for two days. It feels like they are only making statements to get their demand of having the Delhi Police force."

The BJP and the AAP engaged in a war of words on Thursday over "delay" in hanging of the Nirbhaya case convicts, with BJP blaming it on the Delhi government's "complicity" and "sympathies" for them, while the AAP accused its rival of "instigating" people with a "lie".

2012 gangrape: The Union Home Ministry had earlier forwarded the plea, recommending the rejection of the mercy plea, to the President.

The mercy petition of Mukesh Singh, one of the four convicts in the 2012 Delhi gangrape case, was rejected by President Ram Nath Kovind on Friday, sources told PTI.

This comes hours after the Union Home Ministry had forwarded the plea, recommending its rejection to the President, the news agency had reported.

“We are happy that the chances of them getting hanged have increased. We are assured that as soon as they file mercy pleas they will be rejected,” the father of the 23-year-old paramedic student, who was gangraped and brutally assaulted in December 2012, said.

On Wednesday, the Delhi government had informed the Delhi High Court that the four death row convicts will not be hanged, as their mercy petition was pending before the President. The four were to be hanged on January 22 at 7 am.

Pointing out that the right to seek mercy is a Constitutional right, Grover said, “The applicant is entitled to a fair consideration of his mercy plea without the shadow of the noose hanging over him… There is no purpose in keeping the warrant alive as it is in defiance of law,” advocate Vrinda Grover, appearing for Mukesh, had said.

Meanwhile, Asha Devi, mother of the victim, blamed political parties for exploiting her daughter’s death for “political gains” and “delaying” the hanging of the four convicts. Speaking to news agency ANI, she urged Prime Minister Narendra Modi to fulfill his 2014 campaign promise of women safety and ensure that the culprits are hanged to death on January 22, as earlier decided by a Delhi court.

“The same people who took to the streets to protest against the incident in 2012 are now using my daughter’s death for political gains,” she said. “I feel stuck in the middle of this blame game,” Asha Devi added.

Fresh death warrants were issued this evening for the four Nirbhaya case convicts, who are now scheduled to be executed at 6 am on February 1. Issued by Additional Sessions Judge Satish Kumar Arora, the new warrant was signed after the court turned down a plea by Mukesh Singh, one of the convicts, to postpone the date of execution and came mere hours after President Ram Nath Kovind rejected a mercy petition filed by the same convict. The warrant is dated to exactly 14 days from today, in accordance with a law that states convicts to be executed must have a reprieve from the time their mercy plea is turned down.

The three other convicts have yet to file their respective mercy petitions, which they may do at any time prior to their execution. Each time such a petition is filed and rejected, that 14-day period must be observed, thereby potentially prolonging the execution.
