No that is not that it means. So in this case, if both are majors and had consensual sex that's not a rape case at all kadaa. Now if they were both minors and had sex again consensual, it won't be considered a rape case.

But let's say the girl is a minor and the guy is a major, even if it's a consensual act of sex it's considered a rape since the girl isn't 18 while the guy is. Same with the genders reversed as well. I agree that it's just a difference in number but that's how the laws are framed

She is 19... Pharmacy student... knowingly consumed weed... I'm not saying this is bad or fault...may students do but by that time they at least know the consequences... even if they way under estimate them.

Sex with BF... understandable...but if it's really true that with all her brothers also and is consensual... she is having fun time. Accusing of rape is very serious and should be punished...if not, every other girl will do the same.

Most of rape cases are actually consensual sex anyway

You do realize that sex under influence is a culpable offense if the woman is not in a state to give consent?

Encounter lo enduku potharu? If they do, that's the cops fault for not investigating before encounter. I am not saying that she didn't do anything wrong, just that she is not culpable for any offense other than misleading the cops.

Again, she is not culpable. Only people who are culpable are the news channels for defamation.

What do you call false allegations whether they are broadcasted or not ? You can have your opinion but she is no way innocent . She is totally punishable under law.

The essential ingredients of an offence under Section 209 are:

  1. The accused made a claim;
  2. The claim was made in a Court of Justice;
  3. The claim was false, either wholly or in part;
  4. That the accused knew that the claim was false; and
  5. The claim was made fraudulently, dishonestly, or with intent to injure or to annoy any person.

A litigant makes a 'claim' before a Court of Justice for the purpose of Section 209 when he seeks certain relief or remedies from the Court and a 'claim' for relief necessarily impasses the ground for obtaining that relief.

The offence is complete the moment a false claim is filed in Court.

not sure if the case was taken to court, if so papam kastamey aameki
