USCIS fear mongering...the Notice to Appear (NTA) will outline why USCIS believes the employee may not have valid immigration status. It’s up to the employee to provide evidence of lawful presence, such as being within the 60-day grace period, having secured a new job, or having filed for a change of status to another visa category.

Anyway it is case by case...these fake lawyers trying to get more clients.. they don't provide details of who is the employer and if they have any red flags.

Employees are easy target for USCIS and these blood sucker lawyers..

USCIS' Feb 28 [memo( specifically refers to I-129 as a criterion for NTA issuance.

> **C. Beneficiaries of Certain Employment-Based Petitions**

> USCIS will issue an NTA to a removable alien who is the beneficiary of an employment-based petition where:

> * The decision on the petition is unfavorable;
> * The beneficiary is not lawfully present in the United States or is otherwise removable; and
> * The beneficiary is the signatory on the Petition for Nonimmigrant worker (Form I-129

No. Let's say your employer terminated your job on Friday , your h1b 60 days grace period starts now.

Lawyers are suggesting to immediately move to India and apply transfer .

In your case you still have valid job and employer. You won't transfer without transfer is complete. You won't transfer by resigning the job first.

Asap. Once you get h1b layoff.. 60 days grace time lo uscis is issueing nta. Once NTA vasthe it is better to leave asap even if your transfer is in pending approval. Ypu better leave get h1b stamping on new transfer with ammendment.

@kakatiya if you leave you will loose the opportunity to coming back after getting notice. After termination leave in couple days and get stamped other visa

If you get NTA and USCIS doesn't approve H4, then anyways you'll have to go back to India and apply H4 from there again. What's the catch ?

H1b lo layoff ayina vallaki NTA istundhi uscis. What a nonsensical move by current administration.

A Notice to Appear (NTA) is a document issued by the U.S. Department of Homeland Security (DHS) to begin removal proceedings against an individual in the United States. It essentially serves as a formal notification that the government intends to deport someone and initiates the legal process for that. It's not a visa, but rather a document that can be issued to individuals who are found to be in violation of immigration laws, including those on visas

Also why will they issue NTA if you're legally on grace period ?
