You get LCA first and then apply for h1b new, renewal,amendment,transfer.So after this rule is passed, salary mentioned in LCA has to match these new wages and only after that H1B new, renewal,amendment,transfer can be filed.

When you file LCA, you have to indicate if this is an extension or amendment or a new H1. If it is extension or continuation of employment or amendment, this wage level does not apply. I emailed our company immigration lawyer and he responded back to me saying that the new levels mostly will only apply to New H1s filed - the ones that are selected in the lottery or transfers. renewals and extensions will follow the old wage levels, he told me that USCIS made this exception, mostly because of lawsuits that may be filed challenging the wage levels

It wont work like that.

DOL updates wage levels every year and petitions almost always follow the same. Lawsuits won't succeed because DOL is following proper rulemaking procedures this time.
