When you file LCA, you have to indicate if this is an extension or amendment or a new H1. If it is extension or continuation of employment or amendment, this wage level does not apply. I emailed our company immigration lawyer and he responded back to me saying that the new levels mostly will only apply to New H1s filed - the ones that are selected in the lottery or transfers. renewals and extensions will follow the old wage levels, he told me that USCIS made this exception, mostly because of lawsuits that may be filed challenging the wage levelsso in your words you are saying person A as new H1 will have higher wage level against person B as renewal will have lower wage level. lets assume they both got approval for 1 year. what happens when they both go for renewal after 1 year will they be considered in two different wage levelsโฆI am trying to understand the current rule

After rule passes, any new LCA[new, renewal, amendment ,transfer] will be approved based on wage levels at that time. Already have a cousin whose FT company is asking him to work remote from a cheaper county because LCA wage levels will be less there.
