16 и 17 апреля состоялись еженедельные заседания Приморского районного суда, рассматривающего резонансное дело "Лайф-из-Гуд" — "Гермес" — "Бест Вей".

Суд идет с конца февраля 2024 года, в заседаниях пока выступают граждане, представленные стороной обвинения: это 210 признанных потерпевшими, 115 свидетелей, приглашенных обвинением. Допросы лиц, представленных стороной обвинения, постепенно близятся к завершению, через некоторое время начнется допрос граждан, представленных стороной защиты. Для ускорения процесса заседания проводятся два раза в неделю.

 

16 и 17 апреля, как и неделю, и две недели назад, на заседании суда выступали признанные потерпевшими. Адвокаты считают, что, как и в звучавших ранее выступлениях, доказательств неисполнения обязательств компанией "Гермес" не было представлено. На предыдущих заседаниях состоялся также допрос потерпевшей Липатовой — одного из относительно немногих потерпевших, кто предъявляет претензии к деятельности кооператива "Бест Вей". Липатова сообщила, что, проживая в квартире кооператива "Бест Вей", не платит за нее, так как следователь ей сказал не платить незаконной организации, при этом из квартиры не съезжает, потому что ей негде жить, на что получила ответ рассматривающей дело судьи Екатерины Богдановой: "Кооператив работает, платить надо".

 

На одном из недавних заседаний состоялось выступление приглашенного следствием эксперта, анализировавшего документы компании "Гермес", — доктора юридических наук, доцента СПбГУ Ольги Макаровой. Макарова пришла к выводу, что предмет деятельности компании — онлайн-обучение инвестиционной деятельности, а не инвестиции. Компания оказывала клиентам образовательные и консультационные услуги онлайн, продвигала образовательные услуги. Она, согласно договорам, учила клиентов, как вкладывать средства. И средства граждан вносились за оказание консультационных услуг. "Правовая природа договоров — возмездное оказание услуг", — подчеркнула она.

 

При этом есть некоторые пункты договора, которые выходят за его пределы: это пункты о комиссионных, членских взносах и прибыли. Так как компания иностранная, вероятно, есть законодательство той страны, в которой она зарегистрирована, которое предусматривает такие возможности. Возможно, были какие-то партнерские договоры, но эксперту они не были представлены. Договоры в электронном виде — это законно, оспорить условия в договоре возможно: "Не скажу, что он сложен для потребителя, все четко расписано".
