Uttarakhand Assembly passes UCC Bill: Tribals to remain out of purview

The Uniform Civil Code brings a common law for marriage, divorce, inheritance of property, etc., which were earlier governed by personal laws of every religion. The common code bars bigamy (marrying one person while still legally married to another) and polygamy (having multiple spouses simultaneously).

The Uttarakhand government has cleared that the members belonging to the Scheduled Tribes (ST) community will remain out of the purview of the Uniform Civil Code. The UCC will not apply to "members of any Scheduled Tribes within the meaning of clause (25) of Article 366 read with Article 142 of the Constitution of India and the persons and group of persons whose customary rights are protected under Part XXI of the Constitution of India.

This is how things will get worst over the period of time. Keeping tribals out of UCC is actually very important and should be time bound like give them another two generations and bring them under UCC as well.

Okkriki exception isthe sooner or later other communities kuda demand cheyadam start pedtaru and electorally important castes may even demand amendments to UCC’s….This is the threat to UCC in present form. For example, Jatts and Muslims may demand amendments…

Indian society la uniform civil law will become very complicated, I think we are not ready for it yet…may be ne weed two more generations.

Existing personal laws ki amendments chesi chesi ivala intha worst stage ki teesukochinaru….one you start amending such laws, there is no end.

It will take atleast a decade or two. It is difficult to implement in certain states ( esp NE states)  Many people are arguing that it might break the concept of secularism

A lot of our present laws are based on religious beliefs and ancestral rights passed on from generations and we never questioned those laws but amended them from time to time. But over time, these amended laws created more trouble and when disputes reached the courts, it created more confusion than clarity. The best examples are Hindu ancestral laws and Muslim triple talaq. We have to pass the bill to set rules for Muslim divorce.

An overall UCC covering aspects like marriages, divorces, and inheritance common all over the country implemented at the Union level and minor UCC laws at the state level catering to respective states may help frame laws for comprehensive UCC over the next two decades. This is just the start, and will be followed by confusion and protests.

STs ki constitutional protection undanta so makes sense to exclude them or else whole law will be struck down.
