Cop only writes what may have happened based on his knowledge .. and will hand over to Insurance agencies ... They do not determine who is at fault.

Usually based on the info, insurance agencies on both sides will come to a conclusion who is at fault ... If they cannot, they will say both at fault ..

Simple ... since its stop sign and cannot determine who has right of way (both will say they came first)

if he hit you from behind or side, he will be at fault.

if you hit him from side or behind, you will be at fault.
