I heard. State will do audit and if we caught doing second private company job. State will proceed with lawsuit and penalities

I am curious.. Where does this clause get included typically? Conflict of Interest or Non-compete I can understand. But how can a State be in competition with a private entity in most cases?!

Emo baa. I am exploring from India. I will set up an LLC and do contracting jobs only. Okadi kinda pani cheyadam waste. Delaware lo LLC setup chesukunte, identity ivvalsina pani kuda ledu!

Competition kaadu but because of data security, Govt contracts, and a lot of public and Govt data involved.

Its all good as long as you are not caught. State and Federal have strict policies. Not sure about audit, etc. If they find out termination is guaranteed, but private companies leave it at that. State can go beyond that and may add something to your employment record.

There are two issues here - Non-compete clause. You cannot work for another client in same domain/Sector.

Second is Moonlighting. Rules are different in diff states. CA law allows as long as you work for a 2nd client in your free time. But mostly when you sign your full time, it says you cannot do 2nd job. But if you are planning to do, you have to intimate HR and get their approval. 

So if caught, private companies cite 2nd clause and terminate employment but not go beyond that. State or federal might go (I am not sure on that).

Never worked for state or federal. I do not know their hiring procedure.
