Arrival in the USA on F1 Visa: I arrived in the USA in 2008 on an F1 visa to pursue a master's degree at ABC University. 2. Issue During First Semester: At the end of my first semester, I missed a class, which led a professor to report me to the dean. Consequently, I fell out of immigration status. 3. Ignoring the Status Issue: I did not take the out-of-status situation seriously and did not apply to reinstate my F1 status. 4. Transfer to XYZ University: During this period, I transferred my F1 SEVIS to XYZ University. Although I was unsure of my status, the SEVIS transfer was successful, and I continued my education. 5. Legal Efforts to Reinstatement: While studying, I hired a lawyer in New York to help reinstate my F1 status. Unfortunately, after 1-2 years, we lost the case. 6. Completion of Studies and Remaining in the USA: I completed my graduation in 2010. Despite being out of status, I stayed in the USA until January 2015. One more small twist in my journey: Brief Visit on B1/B2 Visa: In 2020, I came to the USA on a B1/B2 visa for personal work and left after 3 weeks. Additional Detail: My B1/B2 Visa Interview Experience in 2020 During my visa interview for a B1/B2 visa in 2020, the visa officer asked me a couple of questions. The first was whether I had previously been to the USA, to which I responded affirmatively. The next question was about the purpose of my earlier visit. I explained that it was to pursue my master's degree at ABC University. After these brief questions, the officer concluded the interview by informing me that my visa was approved and that my passport would be mailed to me. 7. Return to India and H1-B Visa Application: I moved back to India in 2015 and applied for an H1-B visa in 2022 ( in regular Bachelor degree Quota ). My application was selected in the lottery, and my H1-B visa stamping process went smoothly. 8. Return to the USA on H1-B Visa: In 2023, I returned to the USA on an H1-B visa and am currently working here. 9. Current Situation - Applying for Green Card: I am now in the process of applying for a green card (PERM and I-140) with my employer. I understand that while filing the I-485 in the future, my entire immigration history will be checked. 10. Question About Immigration History Checks: I am seeking clarity on whether the USCIS will also review my entire immigration history during the I-140 process, including both my F1 and H1-B records. If anyone has precise information about whether USCIS reviews all immigration history or just the history related to my current H1-B status during the I-140 process, please let me know. Quote

I'm just thinking to stay on I140 approval (H1-B status), that's why I want to know if the immigration history will be checked during I-140 process ? Quote

no01 Posted June 13, 2024 Report Posted June 13, 2024 financial commitments like buying house etc kante, few yrs ikkada settle ayyaka you may get emotional attachment...or may be your spouse/kids might....so munde clear chey mee future spouse ki (assuming ur not married). Also buying a house is not a prob anukunta....u can sell it off anytime in future when u think you need to go back to India for good. Quote
