మహిళల శరీరాకృతి గురించి తప్పుడు వ్యాఖ్యలు చేయడం కూడా లైంగిక వేధింపుల కిందికే వస్తుందని కేరళ హైకోర్టు తాజా తీర్పులో స్పష్టంచేసింది. మహిళల గౌరవాన్ని ఉద్దేశపూర్వకంగా భంగం కలిగించడమేనని తేల్చిచెప్పింది. అలాంటి వ్యాఖ్యలను లైంగిక వేధింపులుగానే పరిగణించాలని కింది కోర్టులకు సూచించింది. ఈమేరకు కేరళ ఎలక్ట్రిసిటీ బోర్డ్ మాజీ ఉద్యోగి దాఖలు చేసుకున్న పిటిషన్ విచారణ సందర్భంగా కోర్టు ఈ వ్యాఖ్యలు చేసింది.

కేరళ ఎలక్ట్రిసిటీ బోర్డ్ లో ఓ సీనియర్ ఉద్యోగి తనపై వేధింపులకు పాల్పడ్డాడని మహిళా ఉద్యోగి ఒకరు పోలీసులకు ఫిర్యాదు చేశారు. తన శరీరాకృతిని ఉద్దేశిస్తూ అనుచిత వ్యాఖ్యలు చేశాడని, 2013 నుంచి అసభ్య పదజాలంతో తనను దూషించాడని, అసభ్యకరమైన మెసేజ్ లు, వాయిస్ కాల్స్ చేసేవాడని పేర్కొన్నారు. దీంతో పోలీసులు సదరు మాజీ ఉద్యోగిపై లైంగిక వేధింపుల కేసు నమోదు చేసి దర్యాఫ్తు ప్రారంభించారు.

పోలీసులు నమోదు చేసిన లైంగిక వేధింపుల కేసుపై మాజీ ఉద్యోగి కేరళ హైకోర్టును ఆశ్రయించాడు. శరీరాకృతిపై చేసిన కామెంట్లను లైంగిక వేధింపులుగా చూడొద్దంటూ కోర్టును అభ్యర్థించాడు. లైంగిక వేధింపుల కేసును కొట్టేయాలంటూ పోలీసులను ఆదేశించాలని పిటిషన్ దాఖలు చేశాడు. పిటిషన్ ను విచారించిన కోర్టు.. శరీరాకృతిపై వ్యాఖ్యలు లైంగిక వేధింపుల కిందికే వస్తాయని స్పష్టం చేస్తూ పిటిషన్ తోసిపుచ్చింది.

Understand the context here.. looks like there is more to the case.. he clearly harassed her…  the debate is whether this is considered a harassment or sexual harassment case..

The problem with filing the cases is that they put more sections than necessary… lawyers will argue that the sections are too harsh and will get the case quashed… either the victim or the police will want more punishment than needed.. 

courts usually have to decide on which sections will apply to the case.. they usually quash the petitions if more than necessary sections are filed
