The day he is out of the country, wife cannot work legally on that status. Unless he is very sure that the WITCH company he is working for will be able to send him back on L1, it is too huge a risk to take. 2 years is a long time in WITCH and a lot can change. Your friend should try another onsite location out of India. Otherwise, you will lose one in hand for 2 in the bush. Quote

It’s same like gambling going to India and expecting company to do L1 in 1 or 2 years. Not sure why they do L1 that soon when many people standing in line there. Incase if L1 is not initiated what is work around? Again H1b then he may need to go stamping? No one can suggest on this type of queries. Have to depend on employer and attorney. Quote
