If you are non-resident, you aren't eligible for that money. if you got it, talk to CPA on how to ammend and send that back. if you don't, they will come back with interest for it.

you need to understand what non-resident alien mean, if you live in USA for more than 6months a year which is called substantial presence you are not "non-Resident". We did not apply for the money, they paid as they know from the taxes paid the previous year.

That is not how it is defined. You qualify to file taxes after living for 183 days (6months).

NR and R for immigration is different. If you lived and filed taxes in the US for five years, you end up becoming R for tax purposes. We remember switching from 1040 NR/NREZ to 1040 filing after five years in the US.

I know that. as long as you pass substantial presence test, you are considered resident, but these credits aren't for non-residents even though you are resident for tax purposes.

the credits are for resident or non-resident in tax realm. So, I expect the same as NR or R. I may be wrong because I did not read the notice for those credits. Please post to be certain.

nuvu apply chesava bro for the payment. They just sent money based on last year tax filings. I checked with my CPA and he said I am eligible for them. If we were not, we would have got letters and rulings based on this.
