If the H4 EAD is removed through an executive order in the coming days, what would be the arguments in favor of retaining it?

Yet kids of legal immigrants won’t be able to get citizenship. They will have to start their life on H4 visa from day 1? Right from hospital bed.

I wonder what would be their status?

I hope courts strike this EO down.

Yep... Looks like Children of H1B may not get SHITIZENSHIP automatically... However if any of the parents gets it then they will be eligible. India will be benefitted from this. RealEstate will skyrocket... If any of you interested invest on Land (especially the layouts which are auctioned by GOVT entities) ...

BELOW IS RESPONSE FROM AI

Based on the Executive Order, children born to H1B visa holders would NOT automatically receive birthright citizenship under this order because:

  1. H1B visas are considered temporary work visas, falling under the category described in Section 1: "when that person's mother's presence in the United States at the time of said person's birth was lawful but temporary (such as, but not limited to, visiting the United States under the auspices of the Visa Waiver Program or visiting on a student, work, or tourist visa)"
  2. The order specifically states that citizenship would not automatically extend when the mother is on a temporary status AND the father is not a US citizen or lawful permanent resident.

So for H1B visa holders:

  • If both parents are on H1B: The child would not get automatic birthright citizenship
  • If one parent has a green card or is a US citizen: The child would still get birthright citizenship
  • If the mother is on H1B but the father is a US citizen or green card holder: The child would get birthright citizenship

However, it's important to note a few key points:

  1. This order would only apply to births occurring 30 days after the order's date
  2. The legal status of this Executive Order itself could be subject to constitutional challenges, as it attempts to interpret the 14th Amendment's citizenship clause
  3. This represents a significant change from the historical interpretation of birthright citizenship in the United States

Would you like me to elaborate on any of these aspects or explain how this might affect other specific visa categories?

Legals ni add chesi they complicated the case and mostly will be struck down by courts, so maybe they want to lose on purpose.

Musk believes strongly that the population is dropping and needs to increase to keep the humanity progressing and im sure everyone agrees to it. But they want to get rid of illegals. So maybe they want to add all these legals and when court says no, request to atleast exclude illegals. So unless they have legal parents in US, they don’t get birth right citizenship. That might not be hard to push. But if they go directly, the court might push back.

Pass endi, it's an eo by president. They know passing law is hard on this. So indirect ga courts dvara they want to reinterpret things. It's a gamble because it will back fire big time if scotus sides with immigrants. Then they'll need a constitutional amendment to stop birth right citizenship not just law which is impossible.
