The EO appears to be just a trial runs to get SCOTUS to take a stand on interpreting "jurisdiction of " on illegals and temporary visa workers. If SCOTUS gets to agree with approach, I don't see why a retroactive application will not be considered, because all those that were born to illegals and temporary workers will then by default have "no jurisdiction". Then the question is federal government has no jurisdiction, how can this apply to only to prospective births with an arbitrary date. Either there will series of other EOs, or a new law taking into account of new interpretation of 14th amendment, or an amendment itself.  The role of legislature needs to be seen. This is not as simple as it's made to look

Unlike EOs having a blackout on communication from CDC, FDA, withdrawal from WHO, this is intentionally delayed by 30 days. Can't help but think some legal exercise is ongoing within his team in the interim.
