H1b by definition if no USC available, then only H1b should be considered. That's the law

Nope, not just GC. H1 By definition, an employer should be sponsoring only if they are not able to find a qualified citizen that can do that duty.

 

"an employer must demonstrate that they have a bona fide job opening, that the position requires a worker with specialized skills, and that they are unable to find a qualified US worker for the role"

you should check uscis website. sponsoring someone h1b when a qualified us worker available is equal to fraud.
