You can apply for GC. It can be dual intent but again GC quota is by birth country, so unless EB5 dates move ahead, there is no scope for GC. But e visa can be renewed indefinitely as long you show it’s running successfully. Spouse can work anywhere. It is similar to having ead where you can do business.

You can renew indefinitely and you are not employer dependent and spouse can work right away. I think if this option was available h1b wouldn’t be so enticing any more. One would get all the benefits of GC ead even without a GC application.

Any alien who wishes to work legally in US can apply for H1B by finding a sponsor. E visa is applicable only for treaty countries. Bulk of H1Bs stuck in backlog are Indians (by birth and Nationality) , E visa doesn't apply to them as India is not a treaty country. Only Indians who were naturalized (or born) in Canada, Australia or Singapore will be eligible. But NOT all H1Bs are eligible for securing a permanent residency and not bulk of them will do it.

Secondly, Indefinite renewal is not guaranteed. Theoretically, there is no cap on extensions that  you can get. But the onus to prove non immigrant intent lies on the applicant. The more ties you have with the US, the more difficult it gets to get a renewal. Which means you buy a house, make a family and all that in US, and don't have significant ties to treaty countries, your E visa may not be renewed, citing immigrant intent.

Why not all h1bs are eligible for permanent residency if quota was not a problem?

It’s all money game at the end of the day. You do business in millions and pay taxes and provide employment to locals then why would government let that person go on the pretext of strong ties. If you work with an attorney who is very well versed with the rules, I don’t think there is any problem with extending indefinitely. At least until the US born kid sponsors you.

You don't seem to understand nuances in the legalese. CBP can simply refuse entry on E2 visa, citing immigrant intent if the admission officer feels so. CBP decisions can't be contested in courts. That's broader stroke of powers accorded to them. Lawyers can't do anything about it. Only certain USCIS adjudications can be contested in courts. 

Yes, it's money game. But E2 visas are petty numbers in terms of capital investment when compared to EB5. Which is why EB5 is in a class of its own. Don't assume E visa to be a workaround for a green card, which appears to be your entire idea.

India tho FTA chesthe, chala crowd ikkade untadhi. Which is why H1b lo laxity ni allow chesaru. They can cap H1B based on countries too. But they didn't do it on purpose. In return, India opened up its market for US companies.
