You stated initially that E2 is a DUAL INTENT, while it's NOT. It never has been. Getting immigrant visa is a different matter. CBP decisions can't be contested in courts especially if it's for something like E2 visa  E2 emanates from treaty, and therefore is NOT CLASS PROTECTED unlike H1B. If CBP denies you, that's it. You can only reapply with them. You can't challenge it in court. It's as simple as that.

No other avenue kadhu, dabbulu leka. If you're rich enough you can directly apply under EB5. E visa is for business, where as H1B is for a job. H1B meedha untu business chese numbers barely some hundreds to thousands untaru in hundreds of thousands of H1B over decades. 

H1B is only status symbol for middle class in India. Very few people with 30 crore and over property in India and steady income will even come to US.l on H1B. Asalu bulk of H1B meedha pani chese valla worth ee antha undadu. Even if you work for FAANG with 300k or so, after taxes and HCOL, you can barely earn over 1 crore.
