CNR Posted February 9 Report Posted February 9 I faced land issues and noticed several of my fellow brothers have land disputes, apartment disputes and lease disputes. I was researching, how to fix it and found government backed land registry( torrens)is the way to go. Similar to aus, canada, few U.S states. So government will guarantee the land, apartment to the current owner , no need owner to carry linked documents for years, government will fix the ownership disputes. Implementing the Torrens System in India: Challenges & Solutions India currently follows a deed-based land ownership system, which often leads to fraud, ownership disputes, and legal complexities. Transitioning to a Torrens-like system (government-guaranteed land title registration) could solve these issues, but it requires significant reforms. 1. Current Problems in India Land System Unclear Ownership: Many land records are outdated, and multiple claims often exist for the same property. Land Disputes: Over 70% of civil cases in India are related to land disputes. Manual Recordkeeping: Although digitization is happening, many land records are still on paper. Multiple Property Laws: Each state has different land laws, creating inconsistencies. Land Encroachment & Fraud: Fake documents and illegal occupation of land are common. 2. How India Can Implement a Torrens-Like System Phase 1: Land Record Modernization (In Progress) Digitisation of Land Records – India has already made progress through the Digital India Land Records Modernization Programme (DILRMP). Integration of Registration & Land Records .Many states are linking property registration offices with land revenue departments to ensure updated records. Satellite & GIS Mapping High-tech surveys are being conducted to ensure accurate land boundaries. Phase 2: Converting to Government-Guaranteed Titles (Torrens System) Legal Reforms for Title Guarantee: India needs a new law where land records maintained by the government serve as final proof of ownership (like Torrens). Title Certification System: The government should issue Conclusive Land Titles, meaning no past ownership claims can override them. Public Awareness & Training: Educating landowners, buyers, and officials about the new system. Phase 3: Implementation & Monitoring Pilot Projects in Selected States: India can first test the Torrens model in states where digitization is complete (e.g., Telangana, Karnataka, Maharashtra). Dispute Resolution Mechanism: Special land tribunals should handle disputes quickly. Gradual Rollout Nationwide: After successful trials, the system can expand across India. 3. Challenges in Implementing Torrens System in India Massive Legal & Administrative Overhaul Required Overhauling land laws and training officials will take time. Corruption & Bureaucracy Eliminating fake records and land mafias will be a challenge. High Cost of Implementation Modernizing land records, hiring experts, and setting up a new framework require significant investment. Resistance from Stakeholders Some powerful groups (landowners, corrupt officials) may resist changes that make land transactions more transparent. 4. Example of Indian States Moving Towards Torrens-Like System Telangana: Dharani Portal A centralized digital system where landowners get a unique ownership record backed by the government. One of the closest efforts to Torrens System in India. Karnataka: BhoominProject land records to make ownership clear. Moving towards automatic title certification. Maharashtra: MahaBhulekh Portal Trying to integrate land records with registry offices. Government is considering introducing title guarantee for urban properties. 5. Final Verdict: Can India Adopt the Torrens System? YES, but in stages. India should first focus on fully digitizing and verifying land records before introducing government-guaranteed titles. Hybrid Approach Needed Instead of a full Torrens model immediately, India can start with selected urban and rural pilot projects before scaling up nationwide Quote

CNR Posted February 9 Author Report Posted February 9 I see lot of people are suffering with land disputes from own brothers, land disputes with double registration , foreign investors also not have confidence on land registration and we don’t have real estate courts. Court cases are going on for years. I think to solve all this government backed registration like torrens system only solve it. Andhra CM CBN and Modi can do it, if they put heart to this issue Quote

CNR Posted February 9 Author Report Posted February 9 This should come from center to implement in every state. Start with rural and then urban district wise. This will clear lakhs of court cases. Government can make money to get title done by torrens system. Government will verify and give the title . This should be independent of political parties. Seperate agency should maintain for torrens system and real estate court to challenge if torrens agency make mistake Quote
