H1B Expiring in 3 Months - Travel to India and Return with 1 Month of H1B validatiy

Hi I am traveling to India and will be returning with 1 month of valid H1b. My company will be filing h1b extension once i return. Can you let me know if any one travelled with the same scenario and what is your experience at POE. 

 

Given the current immigration, will this be a problem?

File premium get approval and travel

Can you postpone your travel until you get the extension approval ?  It is not worth the risk at this moment.

Ask your lawyer. If your employer lawyer cant give gaurantee then dont go !

Consulted immigration lawyer and he said that passport should be 6+ months and that is the only thing. You can travel and return back even with 15 days of H1B validity. And other thing he said if asked the company, tell the agent that all documentation is ready and once entered the filling process will be initiated.

mine was 3 years ago. I had extension in hand and stamping was expiring in less than 2 months. I did not have any issues in immigration. Dont know about your senario.

H1b ki inka one month validity undaga return ayyi extension file cheyadam is risky move. Risk isn't about immigration but it's about extension approval in given grace time of 240 days.

Na friend di extension inka approve avvaledu, already almost crossed 200 days grace time in 240days. His employer filed for extension before 2 months of h1 expiry.  So nuvvu 30 days mundu extension apply cheste there are chances of no approval in given grace time. Appudu malli India trip veyochu😂

 

Opting for premium will solve this probelm. Anyways, if it is consultancy you have to pay for premium otherwise your employer will file for premium. I don't know if you work for consultancy. So choose accordingly.

Sharing the experience of my friend who was in similar situation.

his extension was due for renewal with 2 weeks to his visa expiry. He has to visit India due to an emergency situation at back home. Attorney prepared all docs he went to India and returned with 5 days left and filed extension in premium after 2 days.

he was asked why returning for 5 days he explained his situation. He was a fte.

Thanks for sharing this. I am also a FTE and my employer said he will file premium once i return.

Then buy return ticket as well....  That shows that you have intention of return as well ... Next thing is tell them you had family urgency and you went there to take care of it. Now it is resolved you are back to work. The employer will file for extension (if you have email proof get it with you), if they do not file it on time then you will be returning back to India (show them the return ticket as well).

If it is family emergency in India go and come,  but be prepared for extra scrutiny. If possible proof for emergency travel docs emanna unchuko. 

If the trip can wait - push it out.
