కేసు ఏమిటంటే - నిందితులు పవన్ & ఆకాష్ రోడ్డుపై ఒంటరిగా నడుస్తున్న 11 ఏళ్ల బాలికను చూసి, ఆమె స్థనాలను పట్టుకున్నారు. ఆకాష్ ఆమె పైజామా తాడు ముడి విప్పి, ఆమెను కల్వర్టు కిందకు లాగడానికి ప్రయత్నించాడు. అదృష్టవశాత్తూ, కొంతమంది బాటసారులు ఈ సంఘటనను గమనించి జోక్యం చేసుకున్నారు, దీని తరువాత పవన్, ఆకాష్ సంఘటన స్థలం నుండి పారిపోయారు.

కోర్టు తీర్పు - “నిందితులైన పవన్, ఆకాష్‌లపై మోపబడిన ఆరోపణలు, కేసు యొక్క వాస్తవాలు ఈ కేసులో అత్యాచార ప్రయత్నం నేరంగా పరిగణించబడవు. అత్యాచారం చేయడానికి ప్రయత్నించారనే ఆరోపణను బయటకు తీసుకురావడానికి, ప్రాసిక్యూషన్ దశను దాటి పోయిందని నిర్ధారించాలి.The difference between preparation and actual attempt to commit an offence consists chiefly in the greater degree of determination.”
~~ అలహాబాద్ హైకోర్టు న్యాయమూర్తి రామ్ మనోహర్ నారాయణ్ మిశ్రా ఐపీసీ సెక్షన్ 376 (అత్యాచారం) మరియు పోక్సో చట్టంలోని సెక్షన్ 18 కింద ఉన్న కఠినమైన అభియోగాలను ఇప్పుడు సెక్షన్ 354-బి ఐపీసీ (దుస్తులను తొలగించే ఉద్దేశ్యంతో దాడి లేదా నేరపూరిత బలప్రయోగం) యొక్క చిన్న అభియోగంగా మార్చారు.

I don't think they are saying it is not a punishable offence or a serious offence. Just that there is more granularity to the severity of the offence. In fact, the judges have called this as 'aggravated sexual assault'. And I agree, this shouldn't be in same category as brutal rape even though both are horrible crimes.
