Major Provisions of the Bill Renaming the Act: The bill proposes renaming the Waqf Act, 1995, to the Unified Waqf Management, Empowerment, Efficiency, and Development (UMEED) Act, 1995, reflecting its focus on modernizing Waqf administration. Changes in Waqf Creation: Only individuals practicing Islam for at least five years can declare a Waqf, and they must legally own the property. The concept of "Waqf by user" (recognizing properties as Waqf based on long-term use without formal documentation) is retained for properties registered before the law’s enactment but prohibited for future claims. Family Waqf (waqf-alal-aulad) must not deny inheritance rights to heirs, including women. Property Classification: Government properties identified as Waqf will no longer be recognized as such. The District Collector (or a designated officer) will determine ownership in disputes, shifting this power from Waqf Tribunals. All Waqf properties must be registered on a central portal within six months of the law’s commencement, with provisions for extensions in certain cases. Composition of Waqf Boards and Councils: Inclusion of at least two non-Muslim members in the Central Waqf Council and State Waqf Boards, as well as representation of Muslim women and diverse sects (e.g., Shia, Sunni, Bohra). The requirement that the CEO of a Waqf Board must be Muslim is removed. Transparency and Oversight: Mandatory audits and transparent accounting practices are introduced. Decisions by Waqf Tribunals can now be appealed in High Courts within 90 days, removing their previous finality. Survey and Management: The role of the Survey Commissioner is transferred to the District Collector or a nominated officer for conducting surveys of Waqf properties. 1 1 Quote

Yes, Section 40 of the Waqf Act, 1995, has been abolished as part of the Waqf (Amendment) Bill, 2024, which was passed by the Lok Sabha on April 2, 2025. This section previously granted the Waqf Board the authority to independently collect information and decide whether a property was Waqf property, with its decision being final unless revoked or modified by a Waqf Tribunal. The removal of Section 40 eliminates the Waqf Board's unilateral power to designate properties as Waqf, a provision that had been criticized as overly broad and prone to misuse. Under the amended law, such determinations now involve greater oversight, with the District Collector or a designated officer playing a key role in verifying claims, aiming to enhance transparency and accountability in the management of Waqf properties. 1 Quote

This was the main reason why most the people in Hyderabad and surrounding areas did not wanted give their lands or house for Rent to Muslim's... I heard 4 of my friends neighbors got into disputes and these fellows wrote those properties to WAQF by submitting fake documents. The board does not care whether the property are genuinely theirs or not.. 1 Quote
