So basically your friends are earning extra income on their H1B and H4 visa. A client of mine is an immigration officer and did say that they are closely working with the IRS, and this is the next data point of folks on such visas they are tackling. One I bought in 2020 when the rates were low and after living it in for 2 years moved to new home in 2022. My spouse recently travelled to India and had timo go through secondary screening (POE Seattle) and he was grilled on type of mortgage we have for both properties and did we change mortgage type for the old home when we switched our primary residence. They made him sign some documents regarding mortagage and rental income. We are consulting a lawyer but wanted to check whether anyone else has gone through such experience. Quote

H1 are not supposed to work for anyone other than sponsor....but H1 can invest in stocks and buy homes/real estate.... If you are buying real estate to rent, then if you are managing your own rental like rent collection, maintenance, repairs etc. In other words, if you are the primary point of contact for your renter as his landlord, then It could be counted as working actively... But if you buy a house and rent it and hire a management company to manage it, then it's completely okay.
