The position is already filled by someone....no new job posting necessary if that someone doesn't need GC sponsorship...hence the position is called GC PERM position.... If a position is filled with H1B visa(temp work visa), and you intend to sponsor green card, you need to again look in the market if some one is available. That is by definition. basically filling a vacant job with temporary worker until you actual fill the position permanently.
