GelakoduKri Posted June 20 Report Posted June 20 I lost my job on May 15th, and my new position is scheduled to start on August 1st, which creates a gap of more than 60 days. How can I handle this situation to maintain or restore my H-1B status? Both are full-time and employers or backdate or extend or do funky stuff. Quote

The day ur transfer petition reaches USCIS count. If that gap is less than 60 days, should be fine. To be on a safe side with documentation, see if the company can do the offer letter with start date as day petition reaches uscis or mutually agreeable date. For e.g., if petition reaches uscis Jul 10, put it in offer letter as Jul 10 or mutually agreeable date. 1 Quote

DonnyStrumpet Posted June 20 Report Posted June 20 As long as your petition is submitted, you should be fine. Explain situation to new employer. Quote

Atleast mention ASAP or as agreed instead of fixed start date. Quote
