Enemy Property  

- Properties of those who migrated to Pakistan or China after Partition or wars are seized under the Enemy Property Act, 1968. 

- Applies to Pataudi family because Abida Sultan (Saif’s great-aunt) migrated to Pakistan, though his direct family stayed in India.  

 

Timeline: 

- 2014: Govt declares ₹15,000 crore Bhopal properties as enemy property. 

- 2015: Saif Ali Khan challenges, gets temporary stay. 

- Dec 13, 2024: Stay lifted; 30 days given to claim, no claim filed. 

- July 2025: HC orders fresh trial, to be finished in one year.

The Madhya Pradesh High Court's recent ruling marks a significant setback for Saif Ali Khan and the Pataudi family, overturning a 2000 trial court decision that recognized Sajida Sultan, Saif’s great-grandmother, as the rightful heir to ancestral properties worth ₹15,000 crore in Bhopal and Raisen. These properties, including Saif’s childhood home, Flag Staff House, Noor-Us-Sabah Palace, Ahmedabad Palace, and others, were declared "enemy property" under the Enemy Property Act of 1968, due to Abida Sultan, the eldest daughter of Nawab Hamidullah Khan, migrating to Pakistan in 1950. The court has ordered a retrial, directing the trial court to conclude the matter within a year, citing errors in the earlier judgment that relied on an overruled precedent and failed to consider Muslim Personal Law for succession. The Pataudi family, including Saif, Sharmila Tagore, and siblings Soha and Saba, now faces renewed legal uncertainty over these historic assets

Pakistan lover Nawab, Hamidullah Khan was the great grandfather of bollywood actor Saif Ali Khan.

 He was a staunch supporter of Pakistan and Jinnah. 

He governed the Bhopal riyasat by Sharia law. He even wrote a letter and invited the King of Afghanistan to invade India and make it an Islamic nation.

 Nawab Hamidullah Khan was so desperate to join Pakistan to serve Islam, that he almost pleaded to Jinnah to assimilate Bhopal into Pakistan, and he was ready to serve Pakistan in any capacity. 

However, Jinnah wrote back to him stating that “no ruler could run away from the dominion closest to him”.(Trunicle 15 May 2021)

The Madhya Pradesh High Court has given an important decision in the long-running dispute over the ancestral property of Bhopal's Nawab Hamidullah Khan the great grandfather of Saif Ali Khan. The Jabalpur Bench has cancelled the

25-year-old decision given by the Bhopal trial court and has ordered a fresh hearing of the case. Earlier, the trial court had given the entire property to Sajida Sultan great grandmother of Saif Ali.

The High Court has ordered the trial court to hear the case again and give a new decision within a year

BJP lo join aithe the verdict of HC can be overridden by loksabha and rajyasabha by passing an act

He can challenge hc verdict if it's a divison bench or single judge ruling to full bench

Most of the rulings(70%) stay the same in higher courts too in civil matters
