husband filed for divorce in india and earns 5000$ for month after taxes. Wife filed for maintenance for 50% salary . how much amount judges allow maintenance with no kids and well educated and earning wife

wife  working in india for 30,000 INR salary and husband is working in US for 5000$. Wife visa expired and husband didn't file for extension.

Working or non working doesn’t matter. A grown up person should not use marriage to live a freeloaders life

If Husband is in the US and wife is in India, ask him to file for an ex-parte first. Then husband should search for a new partner in the US without waiting for Indian proceedings. Once husband gets new woman and starts a new life, he can pretty much say  FY to the Indian courts, as Indian courts will now have to balance two women.

Indian courts needs husband income and Indian wife claims for higher maintenance. Poor husband are tortured . Do you know how to handle

If the wife is filing cases in India, don't appear in the court. Get a lawyer and adopt delaying tactics, citing work commitments and refrain from coming back to India. 

After he gets an ex-parte, and he were to remarry ask the bride to fly to the US to get married or marry someone in the US. This will complicate the scenario in two countries as both legal systems get pitted against one another. 

Wife's strong strength always is to ruin husband's prime sexual/fertility and negotiate her settlement through Indian laws. Husband has to play opposite. An ex-parte is valid in the USA but not in India. But an ex-parte opens window to cohabit and marry and have babies with a different woman in the US, and is not bigamy under US law. 

The wife in India gets frustrated, and can contest this in the Indian court, but it gets dicey here.  Indian court orders for maintenance are NOT ENFORCEABLE in the US. The wife can press criminal charges, with 498a as a final option but the delaying method of the husband AVOIDING VISITING INDIA will nullify the impact. Final straw would be an Indian court issuing arrest warrant for the husband and issuing red corner notices (US doesn't care again), but come on do you really think Indian courts would go that far in a domestic dispute ? 

Think of it as a stalemate.  She has to compromise with the amount the husband offers, and has to step back.
