Simple question :: how many bjp leaders went to jail in last 11 years why ED and CBI is only for opposition

This is a witch hunt bill. Allegation vaste resign cheyyali ante ela? There will be some allegations every day.

The 130th Constitutional Amendment Bill states, “In Article 239AA of the Constitution, after clause (5), the following clause shall be inserted, namely:—5A…."in case of the Chief Minister, who for any period of thirty consecutive days during holding the office as such, is arrested and detained in custody, on allegation of committing an offence under any law for the time being in force, which is punishable with imprisonment for a term which may extend to five years or more, shall tender his resignation by the thirty-first day after such arrest and detention, and if he does not tender his resignation, he shall cease to be the Chief Minister, with effect from the day falling thereafter."

 

“In case of the Prime Minister, who for any period of thirty consecutive days during holding the office as such, is arrested and detained in custody, on allegation of committing an offence under any law for the time being in force, which is punishable with imprisonment for a term which may extend to five years or more, shall tender his resignation by the thirty-first day after such arrest and detention, and if he does not tender his resignation, he shall cease to be the Prime Minister with effect from the day falling thereafter," the amendment to Article 75 states.

this is not clear actually….undertrail ga 30 days kante ekuva jail lo vunte annatu chusina….in such cases, even before judgement is delivered, the elected representative will have to resign or loose their position on 31sr day…

Simple…BJP being in power, why would any BJP leader will go to jail ? Isint it how it works ?

For someone to get arrested or fave enquiry, there needs to be a complaint first. Say for example, state of Karnataka where Congress is in power, Did they make an attempt to arrest or put up an enquiry on BJP leaders ?

Nope , it should not work based on ruling party  .. cbi and ed should work irrespective of ruling power .. if the bill is introduced and passed  to remove the cm pm based on cbi and ed cases then ruling party will dictate cms and ministers irrespective of mandate

You are talking about an ideal and theoretical situation and Im talking about practical application of law.

CM jail ki velladu ante...almost pakka proofs unnai ani kada....leda Judje vadiki jail ki enduku pampistadu.

I think this is to remove the loophole...

example....baboru/ktr recent ga jail ki velte..they wanted to come up with bill that CM of cabinet ministers power lo unnapudu chesina daniki..

withchunt laga malli case open cheyodu..exempt cheyale ani...something on those lines..

Now, circling back to my first observation. Isn't it how it is supposed to work ? 

See, it’s very hard to implement a fool proof system. Let’s bring in the law first and then slowly work towards closing the loop holes.

This rule is good when the ministers and public representatives cases should  be closed quickly or else it is not benifitive to anyone obviously it will clean opposition party in these 3 years as they move to ruling party just like cm Ramesh and Sujana
