I got laid off on stem opt on Sept 12th and gave series of interview with the company and got a verbal offer but today I got an email saying

"Our legal council has asked us to pause working with any candidates who would need any kind of employment sponsorship at some point in the future until we can get more regulatory clarity around the recent United States Government action to change the sponsorship process."

Right now there is no clarity on who needs to pay 100K. Of course companies are going to stay away until they get that clarity.

The Secretary of State shall also issue guidance, as necessary and to the extent permitted by law, to prevent misuse of B visas by alien beneficiaries of approved H-1B petitions that have an employment start date beginning prior to October 1, 2026.

They thought through all these scenarios. They did expect lot of opt,f1,H1b to lose employment because of the new rules.
 

the non immigrants are under strict time limit to find new jobs.

 

Even a short term pause by employers is going to be big blow

hiring won’t be the same anymore for h1b, that’s for sure. Layoff aite majority gone case from now on

I didnt get this point, chatgpt ki adiga....so matter entante, ee lottery lo H1 pick and approve aina vallu Oct 1st nundi official ga work cheyyali kada...but some ppl misuse and come in B category visa and then start working before Oct1st...adi prevent cheyyataaniki ani chatgpt cheppindhi

Whole point of this is that people losing jobs on non-immigrant status are applying for B visas within the country. They are not going to allow such COS to B visas. Any non-immigrant without employment must leave the country immediately upon expiration of grace period, 10 days for H1 and 150 days for OPT.

They will be allowed reentry with new visa stamping, or 100k fee confirmation paid by new employer for the new change of employer petition.

i don’t think that’s the reason. the point is to prevent people coming into USA on B visa who also have stamped visa and then apply for change of status to H1B after coming to USA by staying within the country. this way they will try to bypass the $100k payment.

No, both are wrong. It is not about new lottery lavangams. Why would their employment start date begin prior to Oct1,2026?

 

This is specifically to prevent unemployed non-immigrant lavangams from abusing B visas, to force them out of the country first, then require them to pay 100k in case they find new employer to transfer their H1b.
