U.S. Const. Amend. XIV, § 1. The Clause wasadopted to confer citizenship on the newly freed slavesand their children, not on the children of aliens tempo-rarily visiting the United States or of illegal aliens. OnJanuary 20, 2025, President Trump issued ExecutiveOrder No. 14,160, Protecting the Meaning and Value ofAmerican Citizenship, which restores the originalmeaning of the Citizenship Clause and provides, on aprospective basis only, that children of temporary visi-tors and illegal aliens are not U.S. citizens by birth.
