Renting out a house is not inherently illegal for an H-1B visa holder; however, the activity must be passive and not constitute unauthorized employment. H-1B holders can legally own rental property and receive income from it as long as they hire a property manager to handle all active management tasks. 

What is allowed:
  • Owning Property: You can purchase property and earn rental income from it. 
  • Passive Income: The key is that the rental income is considered passive. 
  • Using a Property Manager: Hiring a property management company to handle day-to-day tasks like advertising, tenant screening, maintenance, and collecting rent is the standard practice for H-1B visa holders to ensure the income remains passive. 
What is not allowed: 
  • Active Management:
    You cannot actively manage the rental property yourself, as this would be considered unauthorized employment and a violation of your H-1B visa's terms.
  • Flipping Houses:
    Actively participating in buying and selling properties for profit can be seen as a business and may also be considered unauthorized employment.
  • Unauthorized Employment:
    The H-1B visa is for employment with a specific sponsor, and engaging in activities that generate income beyond your authorized work is prohibited.

Majority of h1b familes who have investment properties have H4EAD.

manage cheyyakudadu - as this is a service which gets paid

So give to realtor for managing , if not they are hunting down the H1 folks for violation.

these ppl are proactively searching for people posting and trying to find their visa status.

Not all. A lot of cases might be both on H1B

It is considered illegal if you are on H1b and rented on your own.

long hours of maintenance h1b owner chesthe illegal. Some properties doesn't need maintenance, in that case no need to hire a property manager.
