Receiving rent is passive task. Everything else is active task like doing repairs attending phone calls for plumbing water etc.

That’s not the point. If the H1B holder gets the money from tenent directly, it’s a violation, if he gets via property management it’s legal. Depends on money trail. 
 

Smart thing to do, if you are on H1b move your investments somewhere else. Why take risk.
