Who Must Pay the $100,000

• Petitions filed for beneficiaries outside the U.S. who do not have a valid H-1B visa.

• Petitions requesting consular or port of entry notification (even if the alien is in the U.S.).

Petitions requesting change of status, amendment, or extension where USCIS finds the alien ineligible for such change or extension (e.g., out of status or leaves the U.S. before adjudication).

Who Is Exempt

Existing H-1B visa holders and petitions filed before September 21, 2025.

Current valid H-1B visa holders can continue to travel in and out of the U.S. normally.

• Petitions for amendments, changes, or extensions for aliens inside the U.S. are exempt if USCIS approves them.

• If such an alien later travels abroad and reenters using the approved petition or existing visa, they’re still not subject to the $100,000 payment

It is not applicable for F1--> H1 

and L1 --> H1 

 

So, basically it will literally work as expected.
