Hello ,

I am looking for an employment lawyer who can help me fight a case of rescinded job offer case. 

I am on H1, joining a new company requires LCA approval from the Department of Labor and filing of H1 transfer with USCIS.

The job offer was made on October 6th, department of Labor was already shut down at that time. My offer later said if there are any delay in the background verification or immigration process, the joining date can be postponed. 

After receiving the job offer, I received multiple welcome emails from the team members and leaders. 

I also received the laptop from the company. 

I exchanged multiple emails with the hiring manager during October. 

On October 24th, the hiring manager informed me that maybe my hiring date will be delayed because of the delay in immigration and I said that's fine. 

Labor Department was not processing the LCAs between 1st October and 31st October. 

They started processing the LCAs from 31st October.

On November 6th, I received an email from HR saying that they are resending the offer because I am unable to join on time. Later, I also received an email from the hiring manager that they came to this conclusion after discussing with their immigration team, which is outsourced (Fragomen). 

Based on their offer, knowing that they are known as one of the best places to work. I had no question remaining that my bad days are over. 

I lost my job in May 2025. Being on H1 it had been an extremely hard time for me and my family. Being homeowner, I had mortgage payments, my son's University fees had to be paid, and a lot more. 

In the first week of November, when I knew it was very close and my joining day is just November 12th, and everything was going to be fine. 

I told my mortgage company that I will resume your payments. I told University that I'll pay the balance. 

I also ordered the solar for our home. I started a lawn renovation project for which I cut down 15 plus trees in front of my house. Got few truckloads of soil delivered that's still lying in my lawn. Once I find a job I wanted to enroll my son for the junior operator driving classes and I did that. Had been living in the frugality and spending only on food and fuel. After the offer bought gifts for my kids. It's been 3 years we are in us and My parents had been eagerly wanting to visit us, I booked their tickets. And there is a lot more what I did. 

When I got the email I was in Costco shopping warm clothing for my parents who were about to come. After hearing the news I spoke to HR and she said this is not reversible and we have taken the decision after a lot of consideration. 

I stopped pursuing other job opportunities after I had accepted this offer and things were moving well. 

Given I am on H1 and I have limited time in us without a job. This is extremely hard. 

When I could not find the job within 60 days after layoff I applied for B2 Visa and the time on B2 Visa is also limited. 

This company has costed me and my family huge mental stress. Our life is devasted. I want to sue this company now. Looking for some who work on contingency basis as I cannot pay upfront big fees being unemployed.

If any of you can help me with referral in your company that would be a great value ad as well . I am product manager in SaaS with over all 22 years of experience.

Is he a fresher or someone immature?? Or is he just saying these things as he wants to claim monetary loss because of this? Who does these kinda things when they don’t have a job for 6 months.. 

Job offers can be rescinded any time. They can even fire someone after they join.. at will employment lo ivanni thappavu 🙁🙁🙁

Until he join shouldn’t celebrate. Anything can happen in between.

Law firms don’t decide on these things.. they meet with immigration to make sure they are not getting into any trouble.. there can be many reasons - funding issues, current political atmosphere on hiring new h1’s, change of mind on new hiring..

Buying a home is not an issue.. he might have bought it when he was in job..

 but setting up solar, home renovation when he is not in job are big red flags.. may be he has lot of assets to back this kind of spending..

contracting lo unde he bought house $5k+ only goes to mortgage. contract done. no job 3 months ayyindi

Last year ide time ki, ma team lo oka contractor ni hire cheskunnaru in October.. after 6 weeks, he was let go before thanks giving.. he got so upset and vented out in the team meeting.. 

manager had to let him go as we didn’t get expected funding in the last quarter..
