If you leave while H1b is pending, that application is regarded as abandoned. You may still get the approval, but it will be approved as consular processing....meaning go out of the country and come back with visa. That also potentially means, 100k purview. There is also NO guarantee that CBP apicer grant i94 till the end of the new 797 as it is not an extension notice that have an approved i94 with it. Mee attorney ki ee info telise vundali. Quote

If some reason he/she decided not to grant i94 till the new date, you can always visit the nearest "deferred inspection" site and get the i94 extended to the new date. Some inspection sites can grant extension based on email also. Quote

First of all, you have an approved I797 that already gives your i94 validity for 3 years.. now you are going to enter with a visa with validity till feb 2026 which will overwrite your i94 from 2029 to feb 2026… CBP fixes issues with wrong entries for human errors that the CBP officers made.. they don’t update if you didn’t provide an original document at the port of entry.. you can carry a copy of I797 instead of the original.. but it is at the discretion of the officer whether to accept it or not… you may get lucky but this is not the right time to take that kind of a risk.. if your I797 is already approved, is there any urgency that you have to travel before you receive it? Can’t you wait for few days? Or are you trying to save few bucks on tickets?? Idi trump jamana.. don’t take risk even if there is a remote chance of running into an issue.. aa tarvata ni ishtam!!
