Don't Travel to India for H-1B Stamping Unless Absolutely Necessary

Over the past couple of weeks, there have been an alarming number of H-1B visa denials from the U.S. consulates in India, especially in Mumbai and Delhi.

The typical situation involves an H-1B employee traveling back on a visit to India, who then needs to have a new H-1B visa stamped into their passport from the Consulate based on the already USCIS-approved petition.  And further, the H-1B employee is working in the U.S. at a third-party client site for a U.S. employer, with one or more layers between.  In other words, the employee is not working at the petitioning employer's site, but at a client site, and the petitioning employer does not hold the contract directly with the end client.

In these situations, the Consulates in India have been denying issuance of the H-1B visa, and then returning the file to USCIS for possible revocation of the H-1B petition.  Once USCIS receives the file back, they will issue a Notice of Intent to Revoke.  The employer has 30 days to submit a rebuttal.  The USCIS will then decide whether to revoke the petition, or affirm the petition and send the file back to the Consulate.  Even if USCIS affirms the petition, this entire process is likely to take several weeks or even a few months to get straightened out.  And in the meantime, the employee is stuck in India with no way to get back to the U.S.

So, for the time being, we would strong urge H-1B employees not to travel to India, unless they already have a valid visa in their passport which can be used to safely return to the U.S.  Such employees should not travel if they will first need to obtain an H-1B visa from a U.S. consulate in India before they can return to the U.S.
