april 1st na apply cheseyi baa....i think you can get grace period till oct 1st...i am not sure....

Nuvvu April 2011 lo ante (grace period) lo H-1 apply cheste...you can stay until a decision on your H-1 is made.

If approved, you can live in the US legally, but you cannot work until your H-1 starts i.e Oct 1st.

If denied, you will be given 60 days from the day the denial notice is sent to you to either leave the country or change the status ( to F-1 ..etc).

Cap-Gap ani oka provision undi... It is for those who have a gap between OPT ending date and H-1 starting date.....but as far as my knowledge goes it is for those whose OPT ends on or after April 1 st, 2011. If this is the case, i am sorry to say but you might have just missed this by 2 days to be eligible for this Cap- Gap extension........ Let me know if you have any doubts.....

I am confident about what i am telling you.....but make sure you also get advice from your school's DSO.

No, it is not compulsory to join in school after April 2011. You would still be considered to be in-status since you have a pending H-1B application....but if that H-1B application is denied.....you will have 60 days from the day you are sent the  H-1 denial notice to either enroll in another school or to leave the country.....So it is up to you to decide if you want to join school while your application is pending or you can just wait for the decision of your H-1.

ledu mama we cant wrk until H1 gets approved....if we have OPT status, then we can wrk or not just we are legal to stay in US until the decision is pending but illegal to work......
