Regarding OPT and H1 ...help needed......

Opt ext expires on mar30 and if apply for H1 on april 1 2011...

1.So am i eligible for work legally... will I be in legal status... i am confused sorry...

2.u guys suggesting me that need not join school even if i apply for 2011 quota..would i be legal status...
and what would be the status...

[/quote]i dont think you can work until you get H1 approved... if your visa is in processing state, you are eligibile to stay in US...

Let me give you an example...

Lets assume you OPT ends in May 2011.

You file for H-1 B in April 2011.

In this case, you have filed you H-1B application while you were in OPT so.....you can contact you school and say my OPT is getting expired but i have a pending H-1 application......Then your school will give you a new I-20 called Cap-Gap extension....which allows you to live and work until the decision on your H-1 application is reached....

BUT

Let us say If your OPT ended in Mar 2011 and you file for your H-1 B application in April 2011 (i.e) in grace period...then your OPT has already expired so your work authorization has already ended.....so you cannot work... and  since you have a pending H-1 B application you are allowed to live in the U.S until a decision is made.

If that application is approved,

You can still until your H-1 B starts but cannot work.

If that application is denied,

you will be given 60 days grace period from the day the denial notice is sent to you to either enroll in school or leave the country.

but pina higlight chesina case lo OPT end ayye time varake wrk cheyyagalam.............i mean till MAy 2011 but not till OCT 2011 when your H1 status comes into effect if it gets approved....................crt me if am wrong............

60 days grace period anedhi naaku doubt mama...endhukanta....athanu H1 apply chestappudu athanu already grace period lo untaadu....OPT appatiki aipothundhi kabatti...so once decision is out...he is done...approved aithe welll and good. denial aithe re-instatement.

A.) No, you cannot work since your OPT ended.

    Yes, you will be in legal status since your application is pending.

A.) If you join school......the advantage is that you can take CPT and work until your H-1 starts i.e (october 1st)

    but it is not mandatory to join school and you would still be considered to be in legal status.



I am also in this same situation..... MY OPT ends on Mar 6th, 2011.......I have to apply for H-1 B in April...... so in order for me to work in between (april and october) i wanted to apply for universities that give CPT....I was thinking of applying.....and i get the news about TVU.....

but manam OPT extension ki 3 months munde apply chestam kada............okavela late ga chesina first OPT expire aindante malli extension OPT approve ayyevaraku wrk cheyyakudadu..............this is what i got info from my UNIV...anduke vallu 3 months munde OPT ext. ki aplly chesukondi ani chepparu............

SO H1 decision pending lo unappudu, OPT status lo unnanthavarake wrk cheyyochu , once OPT gets expired and H1 is pending, then we cant wrk....
