Dude Im telling about the scenario when he applied for H1 while he is having valid OPT.  Then we can work for 2 months by applying for CAP-GAP.

But for the guy who posted this topic.. is not eligible ( bcoz his opt is getting expired before he can apply for H1)

when he apply for H1 while on Valid OPT there is no question of CAP- GAP at all...he is still in status untill a decision is made. But, as for Work authorization....i think he can still work until his decision is out.

Lets say your OPT ends on March 30th 2011. That means you are officially out of status. YOU CANNOT WORK!

CAP GAP is something which you get when you have ALREADY applied for H1B and it is still in processing or approved but not in hand. In CAP GAP, YOU CAN WORK WITHOUT ANY ISSUES! You need this cap gap thing dealt by your university.

According to my knowledge, in your case, you have to apply for H1B before 30th march to continue your work.

For more information regarding you CAP GAP and H1B filing date and its effect, contact your ISS office in university.
