Petition by Students of Tri-Valley University


We, the undersigned students who had registered at Tri-Valley University in Pleasantown, CA, hereby file this Petition with the Secretary for the U.S. Department of Homeland Security (DHS) and with the Director of the U.S. Immigration and Customs Enforcement, kindly requesting DHS and ICE to consider the following factors:
We registered in a University we believed was a bona fide and legitimate University that had been registered with the Student and Exchange Visitor Information System (SEVIS) database.

ICE is the federal agency with powers to monitor the SEVIS program. ICE has a huge budget with thousands of investigators and millions of dollars in revenues and is the agency vested with the task of investigating universities and their eligibility to participate in the SEVIS program. Apparently, it took ICE several months or longer to unearth the fraud with Tri-Valley University. It seems to be patently unfair and unrealistic to expect foreign students who are not familiar with the American way of life and how the system and culture works here to know or be aware of potential irregularities with the University and its set up, internal fraudulent practices of the owner(s) and other internal problems.

We relied on ICE and Tri-Valley University's Student and Exchange Visitor Program (SEVP) designation to enroll at the University. We genuinely believed that the University and its method of working had been blessed by the U.S. federal government, including DHS and ICE.

We are new to the country and culture and just getting acclimatized with the system here was an uphill climb for most of us.

Many of us have invested a substantial portion of our parents' lifetime savings and taken a huge leap of faith by traveling half way across the world to study in the U.S. based on the SEVP program endorsing the University. We thought that we were so fortunate to obtain the F1 visa to enter the U.S. and study here or that we were able to obtain admission and then we could file a change of status to study at this U.S. University.

Honestly, it is a dream come true for most of us to be able to study in the U.S. For many people all over the world, the U.S. is still viewed as the land of milk and honey, the land of opportunity where one's dreams can come true! We relied on the government to do its job and protect us and allow us to complete our education so that we can support ourselves and our families by being able to live in the U.S. for a few years or return to our home countries with a good education and then obtain good jobs in our home countries.

Now, we are really nervous about the ramifications of the Tri-Valley University losing its SEVIS designation and with threats of deportation (removals) for many students. Our lives are asunder. We are in a panic about what will happen to us, our lives and our dreams. How can we possibly face our parents and extended families who had invested their dreams in us for us to pursue our education in the U.S.

We respectfully request DHS and ICE to favorably consider and provide us with all viable options. For example, we humbly request that ICE provide us an opportunity to continue our education and pursue our lifelong dream to study in the U.S. by allowing us to study at another University within the U.S. by allowing another University to issue us a new Form I-20 and then for USCIS to approve the F1 status with a new University or College, or allow us to file a change of status to another status like an H1B or F2 within the U.S. legally if any such options are available to us with an employer or based on a spouse living in the U.S.

We respectfully plead with you not to penalize us or our families and bring shame to our entire family and the village/ towns we come from, by deporting (removing) us from the U.S. and causing us loss of name, reputation, money, resulting in devastation to us and our families and crashing all of our dreams.

We believe that we did the right thing, that we have followed all the laws, regulations and rules by enrolling in a SEVIS authorized University endorsed by ICE and the U.S. government. We completed the required coursework and paid the tuition fees as we were duly required to do.

While the tuition fees may not be considered very high for many living in the U.S. according to the standard cost of education here, for our families in India and in other parts of the world, we believe that the fees are substantial and some of our families had to take on loans and borrow funds for us pursue our goal to come and study in the U.S.

We pray and urge the DHS, ICE and all other agencies involved to kindly exercise favorable discretion and preserve our dignity and that of our families, by affording us an opportunity to continue to study and live peacefully in the U.S. and pursue our dream of completing our education in this great country with the world's best educational institutions.


We, the undersigned affirm all of the above and respectfully request DHS and ICE to please consider this Petition in the spirit of kindness and generosity that is the hallmark of this great nation and its kind and generous people.
