Balakrishna, wife acquitted in shooting case

HYDERABAD, FEB. 4. Film star N. Balakrishna, his wife Vasundhara and their driver Kanakaiah have been acquitted in the sensational case of shooting incident in their Jubilee Hills house, here, on the night of June 3, 2004.

Delivering the verdict today, the Metropolitan Sessions Judge, K. Raja Gopala Reddy, said that the prosecution had failed to prove any of the charges against the accused persons. The scientific evidence presented in the court was not reliable, he said. The judge also dismissed a petition seeking stoppage of proceedings.

The film star, clad in white dress sporting a tilak on his forehead, was present in the court when the judgment was announced. As news broke out, his fans, waiting outside, raised slogans and distributed sweets. Accompanied by the cheering fans, friends and relatives, the actor walked into a temple nearby and offered prayers.

"I thank all my fans and friends who have stood by me in these difficult times. I have come clean because of the good work done by parents," Mr. Balakrishna said, reacting to queries from reporters.

A criminal case under section 307 (attempt to murder) of the IPC and 25 and 27 of the Indian Arms Act was registered against Mr. Balakrishna accusing him of opening fire at film producer, B. Suresh, and an astrologer, Satyanarayana Choudhary. In the course of investigation, a case was also booked against Ms. Vasundhara and Kanakaiah under Section 201 (obliterating evidence) of the IPC. The case took a turn when the Mr. Suresh and Mr. Choudhary, while undergoing treatment at Apollo hospital, maintained that Mr. Balakrishna did not shoot at them even as the police claimed that the duo had deposed in their "dying declarations" that the actor fired at them. The police produced them as two main prosecution witnesses in the cases.

Witnesses turn hostile


However, both Mr. Suresh and Mr. Choudhary during trial told the court that they were "not shot at by Balakrishna, but an [color=red][size=36pt][u][b]unidentified fan standing beside the actor[/b][/u][/size][/color] had opened fire." Almost all the witnesses and the `panchas', except the actor's gunman and forensic experts, turned hostile in the court. Prosecution argued that the gun shot residue found on the cotton swabs collected from the actor's palms was an important scientific evidence proving that he had opened fire. However, defence counsel raised suspicion about the veracity of the swabs, pointing out that neither panchanama was conducted nor was a memo issued while collecting the swabs. The Public prosecutor, A. Ravinder Reddy, and defence counsel, V. Surender Rao, argued the case.
