Some updates on TVU

Based on the Indian Consulate comments we have tried to put together how the Department of Homeland Security will be categorizing the students. They have mentioned three groups:

1. Those who were complying with the US immigration laws, that is, attending classes regularly;
2. Those who were “duped” by TVU and was unaware of the current situation;and
3. Those who actively participated in the so-called “criminal activities” of TVU.

For each of the above there will be different outcomes.

For those compliant with US immigration laws
It seems that ICE will allow such students to transfer their SEVIS number and move to another school
Those who were “duped” by TVU
ICE will decide the extent the students were involved and will decide either to place them into removal proceedings or allow them to transfer to a new school.
Those who actively participated in the so-called “criminal activities” of TVU
In such cases, the student will be placed in removal proceedings and might face criminal charges.

Analysis:
In order to decide whether the student is in any of the category above, we assume that ICE will be conducting individual interviews of the student. We highly recommend that you schedule such an interview in the presence of an attorney. Please also do not contact any government agency without being represented by an attorney.

Re: What to do next?

Many students have asked what are the next steps in the coming days to protect their legal interest or be able to transfer to another school.

- First of all have an attorney by your side. If you cannot afford one, it seems that the Indian Consulate might be providing some free help where to find free legal service.
- Second for those who can transfer to another type of visa(s), please consider such visas;
- Third for those who cannot presently transfer to another school:
a. If you are in removal proceeding, you will need to appear in front of a judge, hire a lawyer and the lawyer will decide whether you should take a voluntary departure or fight your case based on other reliefs;
b. If you have not met with officials of the Department of Homeland Security (DHS) (more precisely ICE), you will need to schedule an appointment through and attorney and possibly attend an interview. Note that again you should have an attorney present during the entire process; and
c. If you have been cleared by DHS, hopefully you should be able to get your SEVIS transferred to another school that have accepted you. Again do not try to file anything without the assistance of an attorney.

Our law firm will soon be accepting calls to schedule the appointments for the students for a nominal fee. Note that because of the overwhelming number of cases and limited resources, we will be able to accompany only students from the immediate region in California in Bay Area and Sacramento area. We will highly recommend that you check with [url=http://www.aila.org]www.aila.org[/url] (American Immigration Lawyers Association) to find a good attorney to represent your interest. You can also check with other non profit organizations to see if they will be able to provide for free lawyers.

We have heard unconfirmed news, that a guidance memo will be issued by ICE soon. Some might wait for this guidance memo in order to proceed.

Important: We are sad to say that unfortunately, at this point, not all the students of TVU will be able to get a successful outcome on the matter.
