[url=http://www.ice.gov/sevis/tri-valley-110118.htm]http://www.ice.gov/sevis/tri-valley-110118.htm[/url] Every student who called the helpline is being given these three options: The explanations about the problems associated with each option were given by many immigration attorneys.1st option- Depart U.S and re-enter: There is no guarantee that the student will be allowed to enter the U.S in the future. Law clearly states that, we need new Visa and we may not get another, so forfeiting the chance to enter U.S in the future. Even if we get a new Visa, We may be stopped at the Port of Entry. So this is not a viable option. 2nd Option- Reinstatement: This is also not feasible option because, reinstatement gives eligibility to those, who violate a rule because of the reasons beyond their control. But I.C.E is considering that, everyone has violated rules with intention, which is not true. They may reject it, if they consider the same way as I.C.E officials. Processing time for this is 6-7 months, so student can’t work on-campus legally. Once its denied, each student would lose as high as $14,000 for 6-7 months including the tuition ( 2 Quarter’s fees) and living expenses. Then we have to leave U.S as soon as possible. Later getting Visa is next to impossible.3rd Option- Voluntary Departure: This leaves an indelible mark on our record. In this case, acquiring the Visa is next to impossible task. It is something like accepting the mistake without any fault of us.Each of these options has its own risks involved and none of them guarantees that the student's record will be cleared and can come to U.S for sure without any issues.Even on 02/09/2011, N.T.A’s (Notice To Appear) has been issued to various students in various parts of U.S. Issuing N.T.A is the 1st step towards Removal Proceedings. This is happening even after they have released guidelines. I think giving guidelines requesting for address and phone no. is only, to find the whereabouts of the students as most are scared and do not want to know where they are.All the options given by U.S Govt are very tricky and strategic and are not viable options. They are indirectly letting us out of U.S., without much public attention and by masking Media’s attention and Govt. of India’s attention. This way they are successful in doing what they want, without getting negative results. This is very clever move on their part.I kindly request you to help the students by putting pressure on the Obama Govt. A large majority of the students are struck even though, most did not violate any immigration rules. All of us are facing this fearful situation because we believed in our D.S.O and thought that, she was directing us in a right path. After all we are students, not criminals and we are not liable to get punished. We do not know the law and we should believe in D.S.O’s instructions, so we did. She should make sure that every student is abiding the law.The I.C.E got to know that, the university is violating the immigration rules in Sep 2009, got some evidences in May 2010 and got confirmation in June 2010 but shut it down in Jan 19th 2011. At least they should have not allowed any more students to get into it. But still the visas have been issued even later. Is this clearly not Govt’s mistake.As Mrs. Nirupama Rao came to U.S to speak to Mr.Obama or his officials and also to Mrs.Hillary Clinton, We request her and the Embassy of India, Washington to take this issue to Obama and see to that, he resolves the issue without giving hard time to students and allow them to transfer to another universities without reinstatement. PLEASE GIVE US A NEW LIFE, EVEN THOUGH WE ARE NOT AT FAULT. PLEASE HELP US. OUR LIVES ARE SHATTERED COMPLETELY.
