Tri Valley University was recently raided by Immigration and customs Enforcement (ICE) for massive visa fraud allegations. In fact, federal government filed a complaint for forfeiture against Tri Valley University for allegations including immigration fraud, visa fraud and mail fraud. Many students were issued Notices to Appear (NTA) for removal, while others were promised fair resolutions on a case by case basis.

The surprise element of this entire mess is that the federal government has yet to indict Susan Su or any of the Tri Valley University Board Members with any criminal charges. While the poor TVU students continue to suffer the serious immigration consequences and the threat of potential criminal consequences, the real wrongdoers roam freely. It seems Tri Valley University lured students into its program with lower tuition fees as well as incentivizing them with further reductions to their tuitions for referring family and friends to the University. Clearly, the University had a lot to gain from engaging in this fraudulent scheme.

While the University had a lot to gain from engaging in this fraudulent scheme, the TVU students had little to gain. Would they have knowlingly enrolled into a “Sham University” to “save a buck” on their tuitions? The logical conclusion is that they may not have enrolled in University that would put them at a such a great risk.

Tri Valley University Board Members including Susan Su can be subject to arrest, detention, and seizure of their vehicles or property. In addition, individuals or entities who engage in racketeering enterprises that commit (or conspire to commit) immigration-related felonies are subject to private civil suits for treble damages and injunctive relief.

The Federal Government should use its wide discretion to charge and punish the real culprits in this mess and not go after the poor students who had little to gain from this scheme.
