Important! Calling H1 Guys

I am writing to inform you that USCIS has decided that when an employee changes work locations an amended I-129 must be submitted for approval. [b][color=#ff0000]This means that each time you change clients you must go through a process similar to that of an H1B extension.[/color][/b]

AILA and other organizations are fighting USCIS on this rule. It is an absurd rule as changing locations does not materially change the terms and conditions of employment (the reason in which one would actually file an amended petition).

I have been informing USCIS of new Labor Condition Applications as they must be informed of your location at all times. Therefore, moving forward, changing work locations will result in amended petitions being filed. Also, any notifications that get returned, I will inform you directly, and we will work together to file the amended petition.

I am to report this news. It is quite ridiculous that USCIS is doing this, but we must protect and preserve your status from any potential fines for non-compliance.
